my soon to be ex filed for divorce sept. 25th, by chance I filed for divorce 3 days later. However, My papers were served on her 2 days prior to hers being served on me. The state allows 20 days after date of service to respond to the papers. Will she have to respond to my papers first or will her filing first be an advantage for her? Also I filed in the county in which we were married and lived for 3 years, she filed in the county where we last lived for a total of 7 months. What would be the proper venue? Thanks

You do not mention where either of you live. Depending on the state, your divorce will be held in the county where either one of you presently resides. The clerks at the 2 courthouses will consolidate your filings to the county where either of you live. Either of you have a right to file a motion to change venue if the selected venue is not satisfactory to either side.

Wherever the first filing was filed will have jurisdiction, and over rides the second
