the Man she had been sleeping with has been living in my attic for a month and i had no idea. when i say living, he has a furnished room..
i came home early from work last week and heard something and then caught them in the act. when i told him to go home, he went up to the attic. i followed him to find that the storage room had become a bedroom. i went to confront my wife and she had already left (i haven't seen her since).
in order to get him out of the house i have to evict him...according to the police.
i am so upset right now. since my wife left, i have no one to help with the bills.. should i just charge him rent so i can make ends meet? he doesn't have anywhere to go.

You need to start the eviction process immediately because he has so many days before has to leave once he receives a letter of eviction(maybe 30 days or so, depending on local laws). Live with a friend until he gets out, and get a lawyer to divorce your wife. Never get married again because approximately 50% of people cheat(about even for men and women). That means 1 of the 2 spouses will cheat and you don't cheat, so...

I'd have your wife arrested and have him arrested as well that way you have them both in a controlled environment so the cops can help you take them to Court and this will help you sort it out then you can make a clear decision Because you stayed she left and never came back their conquests for her behavior in running away he could have killed you she don't know what happened when she lefted

I would charge double the rent and still evict him...sorry low life...you don't need people like that around you and as far as her..you can do better, there is someone out there who will love you and not cheat. Otherwise, you have to serve him an 'Notice to Pay Rent or Quit' wait 3 days and then serve him an Eviction Notice and go to court. Usually takes about 2 mo's.

OK unless he is getting mail there you can put his stuff out on the street and kick him out. now if he is getting mail then you are well in your rights to not only charge him rent but also back rent from the time he started living there. Your wife cant help out much there. I myself was cheated on in my marriage and all I did was divorce him. Well if he is not getting mail there you can through him out and i would change the locks if i were you so he cant get back in and you can keep anything he has since it would be considered squatting he is there illegally you can keep anything he has in that room and sell it for your inconvenience.

if he is going to stay in your attic than yeah charge him rent if you dont want him there get him evicted he can then rent somwhere else or you could charge him rent and tell him he has to find another place to live but he can stay there until he does with a fee doesnt that make sense now but i would have got rid of him if i was in your shoes the day it happened

he should be paying rent, and you should see a lawyer about it all just to protect your interests. you don't know if she was allowing him to stay rent free for service's rendered. either way its a touchy situation. the fact that your wife and him did it in your own home should really tell you what your wife really thought of you. it shows she had little or no respect for who you are as a person.

wow, kinda fu**ed up situation! Well, if you're that strapped for money, then keep him as a roommate, if your wife left, and doesn't care the guy's still living there chances are she doesn't care about him or you, so you should get over that bridge as soon as possible. But maybe you could try to find a new place to live, a little less expensive?

first change your handle from stallion to moron. how the hell does somebody live in your attic and do your wife and you not know!!!! as far as rent cut the power to the attic and go to the pet store and buy some crikets and let them loose up there.
