for you to get arrested, then you were definitely guilty, so i don't know why you want to plead "not guilty."

Caveat: I am not licensed in Oregon, and therefore this should not be construed as legal advice. You need to contact an attorney licensed in Oregan for proper advise about your case.

In many states, a BAC of .08 or greater is a presumption of intoxication to the degree that you are unable to legally operate a vehicle. However, That does not necessarily imply that a BAC of .07 means not guilty. In many cases the prosecution can convict even with a BAC of less than a .08 if they can show the Court beyond a reasonable doubt that the driver was impaired.

You need to consult with an attorney experienced in DUI defense. If you do not have an attorney, contact your local or state bar association for a referral.

My sister-in-law got a duii (we live in Oregon). She was under the limit, so she pled not guilty and did not end up getting in trouble when she went to court. I would ask my attorney's opinion, though, if I were you. I'm sure a lot depends on the circumstances of the arrest, which you did not give.

Get a DUI specialist lawyer. You might just get off. Worth taking a chance. But what is the basis for your BAC? See below for Oregon law and practice:

Usually the percentage is .08, so I think you should be fine pleading not guilty.
