I live in California and have problems with my neighbor's guests parking in my driveway. I can't get to my garage and I have asked them about a dozen times to stop parking or blocking my driveway, it continues to happen. Can I legally block my own driveway, blocking them?

If they are constantlyblocking your driveway and you have asked then it is time to write formally toyour neighbours.

Then each time it happens photo and write to the again explaining that this is causing you a greatinconveiniance as you cannot go about your business and could they ask there guests not park there.

Finally if they have not responded ake a harassment complaint to the police.

Also if they park on your drive you might be able to claim ownership (if its parked on your property) I'd check with a lawyer what you can do in that case though.

You can block your driveway, but you can't block it to stop them from leaving. Contact a towing company and ask them if they'll do pickups from your property, then post a notice saying any illegally parked car will be towed at the owner's expense. Call the towing company immediately you see a violation. The towing company will deal with liability and other stuff, and you'll be in the clear.

I too live in California and you have to keep in mind that the area beyond your driveway is public (the area from the edge of the sidewalk all the way into the street). So if you have people who are blocking your access to your residence then you need to file a complaint with local law enforcement. If you were to block your own driveway in the same manner as those you're referring to then your vehicle can be cited. Sucks I know, but that's the law in this lovely state of ours.

Even though arus.geo says you'd be blocking a public right of way, you're not; it is neither a right of way nor public. It's your private property. That said, you should check if there are any local ordinances against blocking your driveway. Even if you find out you can't block it, the people are still trespassing when they park on private property. Call and have their cars towed. That will send a message better than even blocking your driveway.

Yes, you can. You can't block it in the street but if you were to put your garbage cans a few feet into the driveway so they couldnt park there, you would not get into trouble.

Why not call the cops when they park in your drive way and get get him to write them parking tickets?
Another Idea is to do what other paking lots do -- Hang the warning sign:"private driveway -- all cars will be towed" -- then have the cars towed!

How about putting up a sign saying people can park but must pay $100 per hour. Then if they don't pay you can get a car clamping company to clamp the vehicle while they get the money to pay.

Better still - talk to the neighbours and ask them not to park there.

Ah California, the normal laws of nature and man don't seem to apply there. but if it is your driveway surely you can do what the hell you like in it?

I think you can. Generally I think someone would have to call and have you towed for blocking their driveway.

I don't think that YOUR driveway IS a public right of way.

my son was parked at my house blocking my driveway with his car. which was fine with me. not a problem, however, a volunteer policeman ticketed him for 47$ ! WHAT!!?? surely this can't be legal??? help. thanks!!!
