A friend of mine bought a house a couple of years ago with his business partner as an investment. Although my friend found the money for the house by remortgaging his home the house is in the name of his business partner. Since they bought the house his partners marriage ended. Now, they are trying to sell the house his partners ex wife is trying to get some of the money. Also, His partner is looking for a home a long way away which seems to him and i that he does not intend to pay my friend even if he gets the money and not his ex wife. My friend has not yet contacted a solicitor. What should he do?

He needs to see a solicitor to establish his equitable claim to the property. Perhaps he will have to obtain a declaration from the court that the partner holds the property in trust for both of them. He stands to lose so much if he doesn't move quickly!

No wonder the wife wants a divorce!

I think hes going to find it hard to get money if he isnt named on the deeds. Unless there was a contract drawn up before hand. If not its likely that his business partner will get the money along (possibly) with his wife. Go and see a solicitor sraight away

Has to CONTACT A SOLICITOR! The Law Society can give you a list of the appropriate solicitors where your friend lives. You can call them - go to www.lawsociety.org.uk. Your friend may have equitable ownership of part of the house.

Contact a solicitor.

Get him to apply to Land Registry immediately for a Form A restriction using form RX1. It is free to do it. This should protect his equitable interest in the property.
