I have been having flu-like symptoms for the past two weeks and come to find out, there was carbon monoxide throughout my apartment building due to a faulty furnace. What rights do I have in the State of Michigan? The landlord is a very nasty, rude, old man who has his maintenance staff knock on your door for rent money.

While you can certainly sue the landlord for the carbon monoxide poisoning, first, make sure the problem has been corrected. Next, you have to prove your damages. This is a little trickier; you have to prove permanent damage in order to file a lawsuit in circuit court. You can go for a smaller amount of money, I believe it's up to 500.00, in district small claims court. There is a small fee for you to do this. You don't need an attorney is you choose to file in the district court. You can recover any medical bills and loss of wages.

Take him to court - you may be able to pay rent into an escrow account until he fixes the furnace.

As for the illness - you could sue him in a separate legal matter - but you have to prove that you had carbon monoxide poisoning AND the source of the poisoning was the faulty furnace AND you asked the landlord to repair the furnace but to no avail AND you hire an indoor air quality company to verify the high carbon monoxide readings. You could also involve the media - no landlord likes negative publicity.

unless you can prove that the faulty furnace was a known problem theres not much you can do..

In most states landlords are required to provide each unite with smoke alarms AND carbon monoxcide detectors, check with your state to see if this is true.

Also, call a lawyer, see your doctor, and look into a small claims case. You can band together with other tenants for a stronger case.

Has anyone else in the building had these problems?.....It could be possible to re-coup your money and loss of income if you can prove the cause was his fault. Like if he didn't do proper check of the furnace. I would contact an attorney to see what can be done.....at the least I would also contact the board of health if he fights you on it....they may fine him for not keeping it up to date...

first of all, you need to realize that you have the power to move.
If you know that the place that you live is making you ill, you need to be responsible and move.

You can sue the landlord, but it will cost you money.
The land lord has no obligation to be nice. YOU should move!

I would go through his insurance to pay for you being sick and going to the doctor if infact you are going to the doctor. ( I work at a claims office and have claims like this all the time). If it is pretty bad...then I would start to look for another apartment.
