In most countries, a constitution is a founding document (though not always written at the time of founding) which defines the basic and fundamental laws that apply regardless of anything else. It sets up the structure of the government, and lays the ground rules.

By-laws are not part of most legal systems, in most countries. For example, in the US, the term ByLaws refers to the founding document for a corporation or other group, and functions as the equivalent of that organization's internal constitution.
