It is for the rape of 2 girls not just one.Would that change the sentence?

It is being tried in a crown court-as I type..but only for one of the two rapes. It was in no way consenting. Two 13 year olds.

If you're above 14 but under 18, you're considered a Young Person by the Law. If you're 18 and above, you will be treated as an adult.

You are likely to be sent to Young Offenders Instituition.

Section 90/ 91
This sentence is given for the most serious offences, such as murder or rape, for which an adult would receive a minimum 14 years in custody. The case is heard in a Crown Court and the entire sentence is spent in custody. The release date for Section 90 offences is determined by the Home Secretary, the release date for Section 91 is set automatically.

This would depend upon upon the circumstances. If, for example, he is 16 and she 15, although this is, consenting or not, statutary rape, the law would not usually get involved unless a specific complaint were made.

If, however, the age gap is longer, e.g. 10 and 16, then this is much more serious. Implied consent can not be an issue, or a defence, since the ten year old would be too young to understand what s/he is consenting to. This will result in a custodial sentence (In this instance I would advocate castration and branding.).

If it is true, non consentual sex, then a custodial centence is definately on the books (Damn right), regardless of age.

if the girl is 15 and the boy 16 no allegation of rape it was constentual the police might just give the boy a warning. If the sex clearly wasnt consentual the police will prosecute. If the girl is much younger 14 under the police will probably prosecute depending on the likelyhood of getting a prosecution ie the quality of the witness/victim age of the victim evidence it wasnt consentual (bruises) witnesses etc. sometimes it is hard to prove if the boy has been going out with the girl and the girl has previously consented to a sexual relationship if not penetrative sex.

in the UK the age of criminal responsibility (that is to say it is considered the child knew what they were doing was wrong) is 10 years of age and the child can be convicted of any crime-even one of a sexual nature. if the 16 year old had sexual relations with another person over 13 years of age (but under 16 years of age) that was consensual this is called "unlawful sexual intercourse with a person under 16 years of age". if the person is under 13 years of age then it is statutory rape whether consent was gained or not. if the former occured then all aspects of the case will be looked into and could determine the outcome of any judicial proceedings. if the latter occured then if found guilty the defendant can expect a very severe sentence indeed-it is not unusual for a life sentence to be administered in severe cases-and the 16 year old is certainly not exempt from this.

The maximum sentence is life imprisonment the same as adults but usually the sentence will be more like five years again,it depends on the circumstances.
Any person who has sex with a minor wether consensual or not between parties is Mandatory Rape in other words if a male of any age over the age of ten has sex with a female under sixteen is it classed as Rape even if the female agrees.

Death penalty is usually meted for a person convicted of rape but because the offender is 16 years old, he might be subjected to rehabilitation under the Social Welfare Department.
