Political dynasty is provided for in the constitution wherein a presidential candidate cannot run for another term and the local officials cannot run after three terms. Relatives of elected officials cannot be appointed in positions under them under the Local Government Code. Nepotism is prohibited in government.

Another anti-dynasty bill filed,
but this one has a twist

By Maricel V. Cruz, Reporter

Another antidynasty bill has been filed in Congress prohibiting not only a close relative from succeeding an incumbent officeholder but members of the same family from holding positions with executive positions all at the same time.

The House deputy majority leader, Arthur Defensor of Iloilo, explained there is a need to root out political dynasty “because it is anathema to our democratic way of life and a hindrance to national development.”

As defined by House Bill 4407, “political dynasty is the concentration and consolidation of political power in the hand of persons closely related to one another.” On the other hand, political dynasty relationship is “the relationship that exists between an incumbent elective official and his spouse or any relative within the second degree of consanguinity or affinity.”

Defensor acknowledged that numerous bills had already been filed in past Congresses, but they failed to muster enough support.

That’s why, he said, he came up with a different one.

What makes his bill different is that it does not prohibit sons and daughters of a public official from succeeding the incumbent. Rather, it disallows all relatives of an incumbent from running for positions vested with executive powers such as governor, vice governor, mayor or vice mayor. However, they can run for positions in a deliberative or collegial body such as the Senate, House of Representatives, provincial board, and city or municipal council.

“The idea is to prevent the concentration of decision-making powers in the hand of one family,” Defensor said “There are situations when the father is the governor, the mother is the congresswoman and the son is mayor

P.S. although i have not stated the exact law/Article number, I.E., a president, to avoid Political Dynasty, shall have only a maximum of 1 term of which has 6 years on it and shall not appoint a member of his family for to do so he or she committs Nepotism

Ans:
