My friend's husband verbally and physically abuses her. But she doesn't have any proof of it. She also caught him talking on the phone with other women. She couldnt take it anymore, so she left him. She is now living by herself and wants a divorce, but she has no money to file for divorce. If she tries to divorce him, is there any chance that he is the one who has to pay for everything, including giving her half of his money?

have her contact her local legal-aid society,,,, as stated she may qualify for a pro-bono attorney. if she has been abused, contact the local women center/shelter for help and advice,, depending on what state she is in, if in the USA, the fees for filing vary,,from zero to several hundred dollars, you also can obtain the forms yourself from most county courthouses, and file for yourself ,,, with minimum fees, as to money,, and property, that depends on length of marriage, and what was accumulated during the marriage, and if they have children, and her ability to support herself, nowdays with no-fault divorce, she wouldnt get extra or more due to his bad behavior,,

Win the divorce? it sounds like divorce may be a little harsh in this case. imo the guy needs to start eating some fresh fruits and vegetables--he's edgy. it could be stress from work. those women he enjoys talking to on the phone may just be friends, there's no reason to jump the gun here and assume that he is laying the pipe.

without proof of infidelity, the half thing if she initiates the divorce may be in question. does sound like she could at minimum connect with a battered women's shelter or get some counseling, even if from a local church.

Definatly, he will have to pay.
If she can find an attrorney who will work probono. If she still has access to the mutual bank account or credit card, she legally can take out half of the money.

She can talk to attorneys that will give her a free first time meeting.

depending on what state she is in it could be different, but usually the marital property is divided up. money in bank accounts should be frozen until the financial situation is taking care of. if he has been supporting her during the marriage, everything is still marital property....find an attorney fast, make sure she/he is a reputable one. once i had an attorney that helped me and let me make payments to him.....in the divorce settlement, the attorney's fees can be part of it....just don't let her go back to him. there are safe houses for abused women, find one for your friend, they will help her and advise her what to do next....good luck to both of you.

I don't know if you're in the US but she would be entitled to a percentage depending on how long they were together and if he made more money than her. Her lawyer would ask that he pay the fees but it's not guaranteed.
