I feel like I no longer hold on to the purse strings, where do I stand legally, shall I hire someone new and sack him?

I don't understand the question....

If you own the company, and you gave your child a job he couldn't do? Why is that? Surely you should adopt proper employment procedures... and not nepotism.... as you have just demonstrated your child does not the capabilities to do the role properly.

Not only have you caused ill feeling among your employees you are now going to risk the chance of alienating your son because you want to sack him

Next time, ensure you draw up a job description and a candidate spec so you know what qualities and experience and qualifications your firm would be looking for within a candidate!

You didn't state which country you live in, so I can only go by what I know about employment and labor law in the U.S.

First of all, I've seen many business owners terminate their own children due to the child being unable to handle the business properly.

It seems that if you document carefully any specific dates and issues, you would be on solid legal grounds, especially if you have warned him to not make these same mistakes again.

Hopefully he will go quietly.
