My cousin got into trouble (DUI) and it seems that her attorney hasn't really been keeping up with her case. This seems to be a pattern with this guy. He recently had a very high profile case where he called no witnesses. He of course lost the case. I should say, his clients lost their case. I, and many others believe that he is mis-representing my cousin, if not malpracticing. What can be done about it? I think he should not practice any more.

Many things. get a good legal representative who would both look after his interests and maybe pursue any malpractice. You have every right to be concerned and it makes you think that you could wish this does not happen nowadays but unfortunately it does. Good luck.

After a trial starts it is more difficult, but technically it can be done at any time - however, a very good cause must be given if that representation is a public defender in a criminal case - you can't simply change attorneys to try to disrupt the process.

If there is a legitimate reason, generally it will be allowed. Of course, you may be handicapping yourself by bringing in a new attorney who is unfamiliar with the case.

You could report him to the state bar, stating that his representation is below the level of competency that state Professional Responsibility Standards require.
