Sadly -- you will not just have to prove (with all of the papers entered into evidence) that your ex is an abuser, but ...

Also have to endure an UGLY Custody battle as well.

This is more a Battle to make you miserable than any desire to have custody or visitation with the children -- and the longer he can drag it out and make you pay -- the more he is happy about the situation -- MORE control and Manipulation on top of the abuse you already have SURVIVED.

UNFORTUNATELY -- the violent, abusive ex (and soon-to-be ex) has MORE rights in any proceeding than any of his Victims/Survivors.

talk on your lawyer. distinctive states have distinctive regulations. right here in PA, as an occasion, any toddler born in a marriage is seen a toddler of the marriage. There are different states that have a similar regulation. you should additionally talk with your lawyer your STBX's drug and alcohol abuse. If it grew to become right into a present day issue the decide would desire to take that into attention whilst it comprises no depend if or not he ought to have supervised or unsupervised visitations. If the themes have been an prolonged time in the past his previous drug and alcohol abuse likely heavily isn't an argument. you should do each and every thing which you will to make get right of entry to to his toddler trouble-free. Your son desires his dad in his existence as much as he desires you. You and your STBX would desire to love your son better than you hate one yet another. do not use your toddler to come back at one yet another because of the fact the guy who will lose the main and be harm the main would be your son.

A judge can do anything they want. I am tired of women stating that their ex is abusive etc. If the ex is so bad, why is caring enough to retain an attorney and fight to see his children. You just don't want to share the children period. The judge will likely shut you down for dredging up the past, and you deserve it.

a gaurdian for your child(ren)?? only if you are proved to be a unfit parent. the attorney can ask for anything, it just doesn't mean it will be granted. and yes you will have to go through the whole custody issue. cuz he will drag the dead horse just because he has nothing better to do.
