We moved to our (first) house about four and a half months ago and have been victim to a burglary (they came through an open window), a couple of petty car crimes and then last week my Fiance caught them trying to hotwire the car. He fully intended to chase them off, but as there was three of them (he could just see one) he got stabbed in the arm before they ran off. I am extremely nervous about being at home and we now want to leave; is this something we legally need to disclose to the Estate Agents as it took place outside the house? I want to get out of here!!

I know you must disclose if a death occurred in your home.....You need to check with an agent to make sure exactly how much you must disclose......I don't think you have to disclose this.....However, you should consider at least installing a security system to avoid this from happening you again....Best of luck

Check with your real estate agent -- usually you only have an affirmative duty to disclose very specific things about a house (like lead based paint, mositure intrusion, etc.) Problem is, you can't LIE in response to a question from a buyer. And I'm sure people will ask -- why have you only been in the house four months?

Like the man saying about only four months, say your pregnant and you want a bigger garden/more rooms! That may be lying too but y'know hopefully ...!
Good luck and you may want to install a cctv camera (good deterant) and try and get a motion sensor one that records when someone/thing moves or one u can wire up to your tv and if u hear any weird noises flip the channel then when the police arrive you can give them the tape.

Sorry about your fiance, also in the being proactive agenda you may want to learn a martial art and in case you wake up to find them in your bedroom ... BUY A HURLING STICK (it's thin and light but it's quite hard, just slide one into the side of your bed [just behind the fitted sheet] then you just back away from tehm [helps if you do iut on both sides] and grab it then you take tehm by surprise or you can both grab one and launch at them if tehy go to close, but ablve all pretend to be asleep and hopefully tehy won't attack/rape you)

You are required to disclosed things which directly affect the property concerned, such as disputes with neighbours over land rights, major repairs which have been carried out over the last few years, etc., but all these highly regrettable incidents have nothing to do with the condition of the property. It's best to keep quiet if you want to sell the house. What a horrible situation! Now you realise why the last owners decided to leave!

You have a duty of disclosure to the buyer of anything which you should reasonable disclose, the crime in question is something in a major city everyone is aware can happen, but for example if you have been specifically targetted in a low crime area then you should disclose it, otherwise you may liable for fraudulent/negligent misrepresentation. The injury is irrelvant, just the crime, on the whole, forget the estate agent, its your solicitor which you should discuss this with, once you have told him, if he thinks it should be disclosed and you don't then he/she may decline to act.

You are not required to disclose it.

In some states, you do have the duty to disclose if the home has been the site of a murder, suicide, or some other horrific crime, and some states you don't have to offer the information, but must answer honestly if asked.

Since a) no one died, and b) the violence took place outside, I'd say you don't have to disclose that it happened.

I think you'd be unwise to mention it. You have no obligation and nothing to gain.

ofcourse if people find out that ur fiance got stabbed in that house,they'll be too scared to buy the house and u need to tell the estate agents thats the only way something can b done about it except if u want them to kill u.be very careful and i hope ur fiance is ok now

Don't tell them... just sell and get out of there, only thing, make sure the new buyer is an older couple, not someone who has young kids as this will make you feel terrible selling to them..

Keep quiet say nothing,and if a buyer asks just say you have a new job which means a lot of travelling so it is easier to move than to commute

You don't have to tell the agent but your buyers solicitor will ask questions about disputes with neighbours etc etc

If you don't answer truthfully, the buyer can come back and sue
