He can, but it would get thrown out of court and would be a waste of time for everyone involved. You can sue for anything if you can find an attorney that will take the case. Whether you'd win or even have it go to court is another matter.

Yes , he can, if he can prove that as a consequence of doctor's prediction he blew all his fortune, went out and enjoyed himself, slept with prostitutes, gambled and now as a consequence, Is not dead, is bankrupt, has AIDS and also another 6 yrs to live. Doctor will lose his licence, your workmate will have slow and painful rest of life and lawyers will be laughing all the way to bank. At whose expense ; your workmate and doctor.

Why would he want to?...Is he upset that he is still alive?
He is luckier than alot of people and he should be happy...not worrying about getting even with a doctor that really can't determine when anyone is going to die.......ther could have been a new medication that he was on that contributes to him being alive. The man is a doctor...not God. A human being who is capable of making a misdiagnosis or the severity of a disease....

No, he cannot sue, it was not medical negligence. Anyway, shouldn't he be happy that he is still in the land of the living - tell him to get his butt out the door and live a little rather than mope about trying to sue the doc!

He can't sue the Dr. There is no cause of action against him / her.
If however, the cause of him having 'six months to live' was in a industrial accident, a road accident or something similar - he might be abole to sue someone for compensation for his injuries & loss of earnings etc...if still working.

I believe to sue something has to be detrimental to ones well being, business or family. It is possible that he could sue, that is if he lives in the states. Ask a public defender they would know. Now is your friend unhappy about being alive?

Well no, unless it was maybe a wrong diagnosis, in which case your work mate should have gotten a second opinion in the first place. He needs to find a different doctor and find out what is going on and just be happy he is still around.

Instead of seeking revenge monitarily why doesn't
your friend rejoice because he is still alive? He
should not waste his days chasing that pot of gold
at the end of a rainbow but rather sit back and
enjoy the splendor of it.

No.The act of telling him his life expectancy was in no way negligent. And I can't think of any other claim he could have.
