Hi, I just read on the internet that I can't recieve Spousal Support if I am on Public Assistance. Is that true?? Me and my husband have never had any kids, or "owned" anything in our entire marriage. Is there a chance that I will get anything from him?? PLEASE HELP ME!!

hey sry guys, my dad posted that lol he just wanted to know because he stupid ex wife is going after him for spossal suport when they have no kids or anything and he is upset about it because he pays child support (on another kid that isn't my step moms) so thanks for the help guys!!

BTW My step mom is lazy she has no job she likes to suck money out of everyone!

Call Legal aid. But really, grow up...get a job....you made a mistake..so did he..your getting divorced..support yourself! I don't know why some women feel the hubby's should support them after a divorce...
Why are you on assistance anyhow??? GET A JOB.

Are you currently on public assistance? Spousal support is based on the disparity of income between the two partners.

i.e. He was working making 3000 a month and you were an at-home mom. You would probably be granted spousal support because he has supported you throughout the marriage. (Obviously no one here can say for sure since it is up to the judge you appear before)

I assume since you speak of Public Assitance you probably weren't working, however if you both weren't working and the whole family was on public assistance you probably won't be getting anything from him, because he wasn't supporting your marriage/family the taxpayers were.

Final tidbit, you will only get spousal support (if granted) for half of your marriage length (unless some other agreement was signed before marriage) i.e. married for 4 years, you get up to 2 years support.

You have no kids together and therefore should probably NOT get any assistance from him. Why are you on public assistance and not out working. If the two of you had owned anything or had kids, I could see him paying child support and all, but you should be taking care of yourself from now on. Why would you think that he should give you spousal support? Get a job and support yourself. You don;t deserve anything from him. And I am sick of paying in taxes to support those who can but don't work.

I don't know about spousal support, but I do know that you will only receive a small portion of child support when you are on public assistance. I imagine that it's the same as spousal support.

The quick solution for you? Go out today and get a job.

The only time you might get spousal support is if you were not working and depended solely on him but that also would reflect on not having children and receiving public assistance. You should discuss with your attorney some options with this.

If your on aide - you get JUST THAT, they take all the rest!

IF he has to pay "Spousal support" - but if you are collecting aide - the money will go to them and NOT YOU. He has to pay that money back to the state.

its what is formally known as alimony.... but some states don't recognize it... and it also depends on how long you all were married... me and my x were married (well technically still are...b/c the judge is holding the papers.. we don't know why) since may of 2004..... and i have a son! he gives us nothing...

it is also based on your alls income... who made what portions of the total income

good luck.. divorce is the hardest thing I've ever had to do.. but you will survive! I'm extremely happy now

is he on public assISTANT as well
if you do get something from him it will be count against your assistance
if you truly want money from him , you probably will have to get off welfare get a part time job and you will get a monthly income from him
I douth that it will be much
so thing hard or consult a lawyer before making any finale descission

What can he give you? Why do you want anything fromm him if the marriage is over and you jave no children?
