In my State these are the reasons for being given a sentence of death; multiple murders (killing more than one person), murdering a police officer, murder during the execution of a felony. Examples of murder during the act of a felony would be if you kill a bank clerk during a robbery or a kill a woman during a rape.
There are also some Federal laws which call for capital punishment like murder and treason. The Federal government seldom executes anyone. In fact, I can not remember, nor can I find any reference to anyone being executed by the Federal government in recent years.

Because they did something so reprehensible and were not able to prove beyond a shadow of a doubt that they were unaware of what they were doing. Murder 1 requires forethought. Murder 1 is the act of a premeditated murder and now a days they can use up to 15 seconds before the act to establish premeditation. Death Penalty is not handed out that often in this state but when it is it is usually for something deserving of that particular sentence.

in the united states its only for murder or treason. in order for a murder to get the death penalty, most states require that it be special circumstances ( torture), multiple people serial killers, murder of a law enforcement official or a witness to another crime.
