Could you get a prostitute and pay her for sex legally if you film it, whether you plan to distribute the film or not? I know porn is protected by Freedom of Speech, but it isn't only commercial porn that is protected, is it?

Also, and I know this from indirect experience, Ron Jeremy owns a porn company and he stars in some of his own movies right? I am sure that he collects some money for his "acting" but he is also paying, through his business, the woman he is having sex with. Sounds like prostitution, no?

The difference between the two is more like Dolphins and Porpoises not Lions and Bats.

The reason one is legal and the other is not, is because the law says one is legal and the other is not. The actual difference between the two acts are hard to see. It is not legal to have sex with someone for money, but is totally legal to have sex with someone free. It is not legal to have sex with someone for money, but it is totally legal to have film two other people having for money if you sell that film commercially. A rational, logical human being would never be able to understand this, which is why it is something only lawyers and politicians could come up with.

The bottom line is they could make prostitution legal, they chose not to, they could make porn illegal they chose not to. It is one of those cases where the difference is only what the court says is the difference. Great question.

Well first, porn is not legal in all places so in some states, it's basically the same. I think the film industry is protected by law, especially since the contents of material in the movies is patently stated. Prostitutes are not protected by law like that and prostitution is not really a legally recognized industry like the film industry.

Because it is a type of acting. Their job is to act and not to have sex, therefore it is legal. The porn people have all sorts of licenses to make it legal. Your own personal porn film with a prostitute would probably not be legal but feel free to make one with a woman you don't have to pay.

The women and men in porn are known as models or actresses, the releases they sign indicate that as well.

Ron Jeremy does not own his own porn company, he does however make movies for other companies once in a while.

And yes porn is illegal in most states, and the government is starting to come down hard on the adult industry.

You point out one of the many hypocrisies in our society. The film industry disguises their activities under the heading of artistic expression. The artistic expression has to have some socially redeeming value, or in other words some thinly disguised message and not just raw gratuitous sex. Kidney Boy is right about only lawyers and politicians could dream up the convoluted logic necessary for this hypocrisy to exist.
In my book, it is all the same, illicit sex, sex for pay, prostitution.

Wow, that is a really good question! I never even connected those things together before. I guess because there is so much more money involved in the porn industry--only women make money in prostitution. Kind of unfair, though.

That is a great question. So if a 'john' was to call an escort bringing his video camera along he could theoretically hire the prostitute as an actress and pay her wages depending on what scenes he would like to see in his own video that he is directing and starring it.
I guess if you were to have a written contract with you for him/her to sign and a video recorder set up in your hotel room where could you go wrong. I wonder if that would apply to the 'john' having a casting couch in a hotel room. If he was to say "I am looking for porn actresses and want to see what your credentials are and I would like to film you for a porfolio that I am keeping on amature porn actresses.


I think what you would end up with in the end is a black eye and no video camera.


I like it. I better get my video camera batteries charged up.....

As far as I know the actual filming of Porn in only legal in California in the US.

Its not prostitution because the two people are not paying each other. A 3rd party is paying both of them, so therefore it's porn and not prostitution. got it?
