Hi,

I got married in 2001 in an Arya Samaj Temple in Mumbai. Our Marraige did not work out and was never registered.

The reason for the fall out was alot of fights, mental and physical abuse and torture.

We have been seperated for a year now and I would like to get a divorce.

Though my wife (as most women who are wrong) may like to give this another shot, I am not willing to go through the entire process of getting my mind messed up again.

I would like to know the following:
a. since this marraige was never regiestered - would indian courts have jurisdiction over the marraige?
b. what would be the procedure for getting a divorce?
c. what is the time frame one can expect in which the divorce will be finalized.
d. I dont think my ex wife would want any allomony or money

a) Yes-Indian courts have jurisdiction over the marraige.Your wife will just a witnesses to prove or even a wedding photo is sufficient
b) You need to file a divorce petition in the local court where you both last resided or got maried
c)Well contested case, where your wife is not ready to get divorce will take about 3 years & you need grounds for geting divorce.
d)Courts will decide whether she needs maintenance or alimony based on her earning abilities/status

Divorce is tough & time consuming unless its by Mutual Concent.

If ur wife gives one small complaint to police that you tortured her u will be behind bars u/s 498 of IPC or the new domestic voilence act.So try to talk to her & try to get divorce by mutual concent.

For any type of marriage,
you have to go to a Court for divorce, through a professional serious advocate.
See whether both of you need some councelling before coming to a conclusion.
If nothing works out, there are two types of divorce under Hindu Marriage Law.
1. Dirvoce application from one of you (I dont remember that law).
which takes much time more than three to four years. She will definitely ask for alimony or compensation. You will be directed to pay the fees of all kinds from your pocket to her. Court is sympathetic towards women in such cases. You have to prove through documentary evidences, on each and every thing as to why and how your wife is erring. many many things you will face and you will be dejected afterwards. It is a long proceeding.
2. Another Divorce is by mutual consent. In this both of you agree to become separate and ask for divorce. Here court will give six months time to both of you to reconcile. After the given period, one day will be fixed when your wife will be asked to take the bench and finally say she is not interested to continue her relationship with you. She already confesses that she needs nothing from you, except divorce, then the court will grant decree of divorce. If you are fortunate, if she agrees to this, your problem will be over in six months.
Have you already married, as you are calling that woman, as your ex-wife in your question. If so, be careful, she may provide the evidence, when you will be sent to jail.
When she attends to court herself, no problem. If she attend the court through a lawyer, he will certainly tutor her to ask all the compensation from you.

Jagan and Raman have given u the complete details and thats what is true. But there is another way out. Plan out to fix ur wife with some extra marital affair so that u can skip compensation and and u can get an easy divorce. Please give me all the details of ur wife so that i can intrude and u can claim that she has an affair with me, I can help....HA HA HA...Yeah!!! i'am serious.

FIRST OF ALL IT IS VALID MARRIAGE IN THE EYES OF LAW. IT IS GOOD FOR YOU TAKE MUTUAL CONSTANT AND GO FOR DIVORCE. OTHERWISE THE COURT WILL TAKE LONG TIME FOR DIVORCE AND FEMALE CAN ASK MONTHLY EXPENDITURES.
