A friend of mine said he read in some Medical Journal that Medical Malpractice happens every day in every Hospital. and that every Doctor at some point in his/her career will have commited some form of Malpractice. Is this true? and if so why aren't there more Malpractice and Wrongful Death Lawsuits?

This is true. Malpractice happens A LOT. The reason there aren't more lawsuits is because mostly of people not realizing they are victims of malpractice-because a lot of it is small things. Another reason is because of lack of evidence. This is one reason why majority of hospitals will not allow camera?video camers in delivery rooms anymore when a woman gives birth. Then they have the luxury of having video evidence if something goes wrong. A lot of malpractice is simple-for instance, a doctor or specialist not noticing something small on an x-ray that another doctor notices. As far as wrongful death-when a loved one dies, most ppl are too distraught to point a finger.

The reason all comes down to money - seriously

A lawyer is not going to take a case unless it is going to make money. It can cost around $100K to litigate a malpractice claim. The lawyer will probably take 1/3 after costs.

So, if the damages are not significantly above 100K, then it is not worth it to take a risk on the case.

It happens pretty often. I am not too sure about every hospital every day. Doctors are human and medicine is not an exact science. And they have insurance and lawyers to handle lawsuits. Plus in most sensitive cases like surgery you have to sign a waiver and disclaimer.
