I've always thought they have to pull it before it expires, but a large chain grocery store I shopped at didn't and I ended up with 4 boxes of rotten cereal. Can they do that legally?

No it is not. They can sell things even if expired but usually they will discount the items. Where I live they put the old stuff in a cart and have signs that say how much the deep discount is.

You need to check the expire dates on all products. If the cereal was very stale and you bought 4 boxes. The next time you go to that store ask to talk to the manager. Don't be mean about it , just tell him/her what happened and that you were very annoyed, inconvenienced and ask for a refund or 4 free boxes. If you ask it is very likely they will want to please you and get you back as a customer.
They are likely to apologize all over the place and give you 4 boxes and check the expire date to be sure these boxes are good.
might even throw in something extra for bringing it to their attention. Do have a list of the names of the cereals so they can check all of those boxes still in stock.

Yes absolutely it is illegal. The shopkeeper only thinks about money but does not care who will suffer for it. Always see the details given on the item near the price tag. It can lead to some disease and it's unhealthy too. There is waste of money also as u could'nt use the item and it's thrown away because it is expired. The manufacturer observe and based on the experiment done they give the expiry date after which it is advisable to not buy such products.

I don't think it's illegal but it is pretty gross. Cereals expirey dates are like 3 years! Wow, how can they still have that on their shelves?! I remember a few years back, there was a cover story on the news for Dominion selling old fruits and vegies. It was a BIG deal because their tagline is "we're fresh obsessed." and they're store policy is if you find anything rotten, you get your money back.

it would be impossible to keep up with all the food expiration in the store. They try to focus on the refrigerated goods but sometimes they don't get to it. You can take it back to them and make a fuss to get your money or new cereal. But legally you as the consumer need to check expiration's.

The expiration date is a consumer convenience and it is your responsibility to check it if you are interested.
Better stores pull expired to maintain their reputation, but some discount stores are actually based on the resale of expired items they have purchased at steep discounts.

I don't think you can sue them in this situation, but you could sue them if you took the cereal back and they wouldn't give you a refund. Just bring the boxes back to the store and they should gladly replace them or give you a full refund.

They should give you a refund, but the lesson is buyer beware. Always check the dates on products you buy, it make take a couple extra minutes but it may save your life. And I think if it is not unlawful it should be.

Most of the stores have a sale on near expiry date stock....
Maybe these were overlooked?
Take them back and remember to check the expiry date on all products you buy!!!
