Congress creates the Food and Drug Administration. They don't go into the details; they just give broad outlines. They give the FDA the authority to make regulations on the testing of drugs. They may have oversight in Congressional committees.

The Head of the FDA is appointed by the President and approved by the Senate. He hires experts to write the actual regulations and other experts to enforce them. When a drug company wants to test a new drug, they have to follow the regulations. If they fail to do so, the FDA may fine them, or deny their approval.
