I'm not sure about a diversion program in California. But I think your best bet is to talk to a lawyer. Initial consultations are free and they will know your options. Because it is a first offense, I would imagine you could probably do a certain amount of community service to be acquitted. However, your being charged will remain on your record. You can have it expunged which will erase it from your record, but you'll need a lawyer and you can only do it once.

I am not sure of a diversion program that is available for theft. I know there are those kinds of programs for minor drug offenses. I can almost guarantee this is what will happen 1-You are put on probation 2-You have to pay back the value of your theft 3-You can't go back on the premises and 4-you might have to do community service where you have to "donate" some of your time to a worthy cause. Here in NC-most people who do community service work at the Salvation Army or similar programs. Usually, they just sort the donations and the like.
You may or may not keep this on your record. The judge can order that after you complete your community service and pay back the money, to purge your record so that it isn't on there.
You don't say your age-but if you are a minor-usually your records are sealed anyway.
At least you recognize you wronged and you aren't trying to make excuses and I think that in and of itself is commendable.

If you are wanting to do to a diversion program to minimize your behaviour, then it has already failed!

People usually don't shop lift for no reason ! I suggest you find out what it is and deal with it or this will be just a recurring issue in some form for you your whole life!

I suggest you find a competent Psy.D, and do some testing and work on your issues! You will feel much better about yourself!

Many who do what you do are obsessive/compulsive or kleptomaniacs with other issues that need treatment!

Diversion programs are usually a mechanism to minimize the consequence of ones behaviour, and if not learned, you get no second chance!

Good luck!

Ok, I'm an attorney in CA. Every county is different. In Sacramento County, there is a diversion program for first time offenders (assuming of course, you've committed a petty offense in shoplifting-small value) you have to go to Court then on the first appearance the DA's office will tell you if you qualify. In our county, you pay a fine, watch a video and answer questions in a booklet. Once you've completed that, your charge is 'dismissed in the interest of justice.' Go to Court for your County and they will tell you if you qualify for any programs they have. Good luck.

Like California is hard on crime? It's run by a kumbaya gang of leftists. They'll pat you on the head and tell you to be nicer next time.

If you were caught in the act, fess up, act like an adult. Be willing to say that you have a problem and you need help.
