I'm not an attorney, but this is what I think...A father is responsible for payment of child support. You are right that if you take him to court to make him pay his fair share of child support he may attempt to take your child. In Indiana, the court doesn't presume the mother or father to be the better parent, but looks at the situation to determine who would be the better custodial parent.

If you are worried the Daddy would attempt to take custody because you aren't in the best living situation, perhaps that should be a wake-up call for you to get your life in order. When your home life is good, then you can attempt to get a child support order from the Daddy without fear of what he might do... Having the Daddy pay regular child support will help you and your child in so many ways.

You might want to start to keep a calendar of when he visits his child, what they do, how long he stays...etc. That could be important if you go to court. On your calendar you might want to keep track of how much child support he pays and when he pays....

If you can't afford an attorney, contact the court. If you have received government benefits, an attorney may be assigned to help you (the government wants the Daddy to pay child support too). You can contact your county's bar association for a referral for a pro bono (free) attorney. This is the link for the Indiana Justice Organization http://www.indianajustice.org/Home/PublicWeb
Your state should have the same type of services.

GOOD LUCK

Are you asking whether you should take him to court to force him to pay regular child support? If so, the answer is Yes. That's the only way to get a regular payment. He fathered the child, he is responsible to contribute to its support until it turns 18. And no, he cannot take the child away from you. He would have to prove that you are an unfit mother. Unless you are an alcoholic or on drugs, any court will award custody to you. Go after him and good luck!

You need to go to court to establish custody and support. It only takes a few minutes to create a life but a lifetime to pay for it. The guy needs to pay for the child he helped to create.
As long as you provide a safe environment for your child you should have no problem with it, but I am not a lawyer, just mother of a child with a dead beat father.

First of all if you have a safe home for the child there is no way they will give her to him!The court 90% of the time favors the mom over the dad! From the way this sounds he don't want his child!I say forget the child support and go to terminate his rights!

as soon you give him child support he may ask for visitation right.and if he can prove you do not have a set home and he is more stable than you are and can provide for that child.Like it or not the best interest for that child will prevail.

Go talk to a lawyer/attorney. He can give you good advice and some of them don't charge for the first orientation.
