Well, maybe not illegal in the sense of a crime, but it could be a crime--it would have to be criminal trespass. The reason why I am not clear here is that criminal trespass usually applies to entering into a secured place or occupied premises, but can also apply if the trespasser has been ordered to leave any premises where he/she has no right to be. It is most certainly the tort of trespass. A tort is wrongful behavior against a private person, a private wrong (versus a crime which is a public wrong). In either case the police can be called and the owner of the premises has the right to sue in civil court, even if there was no crime committed.

It's illegal for someone to be in your back garden without the owner's permession (unless it's to do with services like electricity, etc, whose access rights are written into the deeds of your land). It's trespass.
It gets a bit more complex if you are a renter, and it's the landlord in the back, but I'm assuming we are talkming prowlers/stalkers/burglars here anyway? Or are you having access problems with neighbours? If so, check your deeds to see what access rights exist for your back garden - there may be a path that actually runs through your property.

They are on your private property and have no business being there , so it would be your choice to run them off or if your not comfortable with that call the police and report a prowler in your back yard. Police handle these situations all the time. Perhaps put up a no trespassing sign which would surely make it illegal if you have it posted.

"Trespass to land occurs where a person directly enters upon another's land without permission" - so yes it is illegal unless you gave them permission!
This falls under the law of tort, and not criminal law, so you would have to prosecute personally through the civil courts, however if you feel you are in any danger at all i suggest you contact the police.

its illegal for anyone to be in your back garden whatever time of day/night it is? you garden is part of your property, and if the person has not got the owners permission to enter the premises this is intrusion.

it would be illegal for someone to be in your garden at night or day if you didn't know them but if you gave someone that you know authority to go in your back garden then it not illegal

If it is clearly private property, they are trespassing whether it's day or night. There are various laws about loitering on enclosed premises and loitering with intent so they can be prosecuted if the police and CPS aren't too busy dealing with terror threats and gun crime.
