When there is an order of stay on stay, the owner of the property is prevented from selling it. If he does that the seller is at the peril of having the sale set aside, by the same court. There are several decisions to this effect. However, if there is only a notice on a stay petition, technically you can sell it. But, you must inform the prospective buyer about the fact that there is a notice on a stay petition before a court of law. It is for him to decide.

No, it is possible to sell the flat if there is a legal notice of stay order for selling the flat. Because, in case if you sell then such sale is not legally valid.

Anything is possible. So long as there is no recorded instrument on the deed stating that the flat can't be sold. A legal notice of stay order is just a piece of paper that is not attached to or recorded to said property deed.

no it is not possible unless the stay order is vacated.even the purchaser will also be in trouble. concealing the facts means invited troubles.purchaser will also take steps and enquire about the title deeds, no encumberence certificate etc.,
