If the father is behind on 2000 dollars in child support and has a arrangement with the court to pay 50 a month and he has been keeping his arrangement for a year or more with the court and making his child support payments on time, can the court still punish him for not picking his kids up every other weekend like the court ordered. Because he can not get along with the mother.

Child support, custody and visitation are all separate issues. The court can't punish him for not spending time with his kids, but they can increase his child support, if that support was based on shared placement. It shouldn't matter if he and the mother can't get along---if he wants to see his kids--he will grit and bear it for the few minutes it takes to exchange the children. That excuse doesn't cut it. They can even get a third party to bring the kids to and from the moms if he really wanted to see them.

The court won't punish him for not seeing the children. They will punish him for not paying child support.

There's a program in some states called "Mediation" and it is handled by Child Support. He could ask to be enrolled in the Mediation Program (it is a free service), and that means he and his wife will meet and discuss visitation rights and they will be counseled about what is best for the children. Each of them can state their problem.

The Child Support program believes that if it is possible, both parents should be with the children as ordered by the court as they believe the children need both parents to be there for them for a healthy upbringing.

If its court ordered that he pick the kids up every other weekend and doesnt, then he is in comtempt of court. Even if he does pay his $50.00 a month. He is suppost to comply with the court order.

If he cant get along with the mother, the he can ask the courts to have a mediator get involved, friend or family meet him somewhere with the kids so he doesnt have to see the mother. If he wanted to see his kids bad enough he would figure out a way to see them.

Of course, especially if the mother should complain. It would be better if the father appealed to the court for other arrangements in meeting with the children, before the mother complains.

nO! little one help is ordered via the little one offerings court docket. means exclusive then the household court docket. he demands to move New Mexico and dossier for Custody and Visitation on the household court docket within the county in which his son is living. this may occasionally get him visitation and a time table which the ex will must comply with.

No the court only really cares about the fulfillment of the obligation of payment and not really about the fulfillment of visiting privileges.

no, be glad you even get 50 dollars a month.. some pepole dont even get that.. and some pepole have to fight with there babys dad because they both want the baby..

Nope he does NOT have to exercise his visitation if HE does not want to.
