If it was never a real marriage then it didn't happen. That is, if it was not a legal marriage then the people aren't married.
If it was indeed a legal marriage, then you can request an annulment through the courts. That will invalidate the marriage and make it like it never happened.
In a divorce, there is a record of marriage and a record of the divorce decree.

If by real marriage you mean it is a common law marriage then just move out or leave. If it is a marriage which means you have a marriage certificate the only way out is a divorce.

If you can't figure it out, ask some one who is familiar with N/Y
divorce law..

If you want to get an annulment, you are going to have to meet certain criteria. If you don't meet those criteria, I suggest you file for divorce. Get an attorney and check the requirements for the state of NY.
