The woman is asking financial support to my huhsband telling that they have a child, which is not true. I want also to file a case for her. What should be the case?

Seriously, if the child is his and she wants financial support that badly - she could easily take it to the state and request a paternity test (income doesn't matter in those cases). You could definately go after her for emotional stress and any other physical or emotional diress that this may have caused on your personal state or the state of your marriage, however this is something you seriously should consult a lawyer about. In addition - I would request a paternity test be done prior to considering a lawsuit otherwise you will have no case. No judge is going to hear a case where you are claiming that her false accusations are causing you emotional harm if you can't prove that the accusations are false.

First things first, you need to get a DNA test for that child. You may have to accept the very real possibility that your husband may have been unfaithful to you, which may be hard to do. If it turns out to be true, I'd file for a divorce from the hubby. If not, countersue the woman for infliction of emotional distress. But, you may have to prove she did this intentionally in order to collect.

My first reaction is, how do you know it's not true? And is this your idea to file, or his, and you're asking here on his behalf?

And why are you wanting to "file a case for her"?

This is all very confusing. Trust is one thing, but get his DNA tested. You deserve to know the absolute truth.

Before anything, there needs to be a DNA test. Talk to your husband, see if there is a chance the child is his.

found in every case involving more than a few of my male acquaintances those claims are generally true....might ask him to take a DNA test to prove he is not the father (in order to win the case that is...not that you doubt him...wink wink)

What proof does your husband have that this is NOT his child? I suggest a DNA test first.

I would have a DNA test first before doing such a thing. You wanna make sure that the kid is not your husband's.

girlfriend, what are you gonna do if it is true, and she does have a child with him? Paternity test ever come to mind? Have one done, thats the only way your gonna prove its not his, and if she's lying then there you go, you got proof!..........
