I live in Oklahoma, and it's 12. But, it can happen before the age of 12; you make a request via your attorney and he sets up a court date and the case is presented before a Judge, with the child's plea....and so on.

Most state divorce courts are now letting kids decide this when they can reason. The judge usually takes the kids into his chambers without the parents and asks them some questions and if the judge is satisfied with their answers,then he lets them decide. I have heard of cases where a child of 4 was allowed to decide but its basically upto your judge. Good luck

that is not so ordinary as that. In Texas, a baby the age of 10 may be interviewed, and a baby the age of 12 can fill out a sworn statement pointing out their determination, yet ultimately the choose will settle on what's contained in the youngster's best interest.

I believe its at the age of 14. This may where the judge/ court feels that the child can make the correct judgement.

I know that in PA the age is 12! It really depends on where you live and what a judge says!
