Generally speaking people use graffiti to communicate. Graffiti can be used to communicate a show of dominance, a claim to a geographic location, an advertisement for a gang or "clique", or a death threat aimed towards an opposing gang member. There are a lot of different uses for graffiti, but generally speaking it is a way to communicate a message to others. I know here in California there are penal codes which specify the penalties for graffiti covered under penal codes 640.6 and 594. If the graffiti causes less than $250 than the penalty is an infraction or better known as a ticket or fine not exceeding $1000. If the graffiti causes more than $250 but less than $400 than the crime is a misdemeanor punishable by up to 1 year in a county jail. If the damage caused by the graffiti costs over $400 to repair than the person is guilty of a felony punishable by state prison time. Also note that if the graffiti can be proved to benefit a criminal street gang then a gang enhancement is enforced (PC 186.22) and can lead up to an additional 5 years in State Prison.
I believe that these laws should be enforced to the fullest extent and there should be no room for criminal street gangs in our society. Criminal Street gangs are an inhibition to the advancement of our society as a whole.

I would think there are penalties. My father working on the railroad I would see a lot of this graffiti on the cars as we would go to the railroad yard to visit him at lunch or other times as a kid.
I personally see a lot of graffiti as art! I think if these taggers would take this artistic ability to good use instead of bad we would have a more beautiful world.
Start a paper trail of the graffiti on your property. Take pictures and make a police report. Like all artists after a time you can tell who is doing what. Some of the graffiti is even signed by the person!! Some times you got to look for the signiture...Therefore being able to find and make the person responsible pay restatution.....
Good luck the law does not consider this a high priority.....

There seems to be two sort of graffiti artists. One is the local kid who just tags, and very often for the same reason as a dog pees on the lamppost - it is a graphical form of scent marking to announce ones presence. Of course if you are annoyed by their artistry so much the better. Unless you are like me and believe that nothing is a work of art unless someone is willing to pay for it.
The other type takes a more professional approach, and often work in gangs and photograph their tags and regard those who don't like their work with pity
If you are having a graffiti problem it is more than likely to be local kids who can innocently have been home all the time, but let the police know you are having a problem. It is considered as vandalism and is a criminal offence. Certainly in the UK.

Yes, they get their hands slapped sometimes, and sometimes no. People who do this are statically uneducated, ignorant, stupid, imbecilic, morons. Other than that they are probably nice folks.
