I see a lot of bad answers (info) here on this one, knowing from my own life, Me and my GF have two boys together and we share the custody of them, the state had us go to court a few years back and fill out and file all the papers for this.
prior to 1998 any child born out of wedlock required both the mother and father to do as we had to, go to court and fill out and file all the papers saying that whom the father was, and any child support the person or persons that had custody of the child was going to be. then the judge had to approve and sign them too.

after 1998 a law was signed and this process is no longer required. after the mother and father sign the birth certificate each are stating that they are the mother or father of said child and custody of the child was going to be with both (unless you did go to court and file papers requesting that the mother or father had sole custody of the child) the only thing left to do is for the mother to fill out the requirede child support papers if she wants.

so the answer to your question will be: if your children are born prior or after the date above will give you your answer.
look just seeing this as you wanting to take your kids out of state for a set time i would ask the father(BF) and have phone #'s just in case anything happened, now if your wanting to move out of state you will want to look over all the brith paper (and any court paper if you do have any)and i would go and ask the court (judge) if you have this right as you don't want to be miles a way and find out that you have a warrent on you. play it safe and be kind and inform the BF/father of your plans.

1st what did u try to spell? constited? Sorry. Does he pay child support? Is he on the birth certificates? Does he have any legal right to the kids? Please call up a lawyer B 4 U do anything!! That way u do not get into any trouble. Good luck!!

Not really. Now their father could press charges against you especially if hes paying support and has visitation rights. If he does then you have no legal grounds to stand on and will constantly be watching over your shoulder for the police to see if he did or not. Better to get written permission but not always possible so hope you have a really good excuse if you get caught for doing so. Good luck

Not without a legal court order from the state if he chooses to fight this matter you could be brought back into court on this matter.

It depends on the state your in, here in my state no way you would be charged with kidnapping and put in jail even if you have soul custody check you state laws and your court order. good luck and enjoy

If your boyfriend has absolutely no custody over the kids, then yes.

That isn't any of his business if you take your children out of state, he is just a boyfriend and you have custody, you can take your children anywhere you want to even abroad if you wanted to.

If she has "sole custody" and there has never been anyone to tell her she can't. Then yes it's legal. Boyfriend has no say.

If you were never married...He does have parental rights....but you have sole custody. I would still speak to an attorney just to be sure of your state's laws.

If she has sole custody / only going on vacation / dad's name isn't on the birth certificate / you are not the father..then, yep she can do whatever she wants to do!
