Basically this would be considered marital adventure and he could be entitled to half of what its worth unless you make some kind of deal outside of the courts with him. Just think of what its worth for you to keep him out of your business for ever and get it down in writing for future reasons. Good luck

If you put the business in your name and perhaps one of your children's names......then he shouldn't be able to take it, but check with an attorney to be sure. Are you using any of his money to finance this business?
Does he know about the business? Would he fight you for half of it? If so, then you would be totally better of to wait til after you separate to start the business to avoid any problems.
