I know someone who recently got a job as a CNA and when the employer did a background check she was fired. Reason given was her husband had an arrest on HIS record for possession of a controlled substance (it was a small amount of pot and he did not have to go to prison.) She is the bread winner of the family with two children. She is appealing the decision but I wondered if this was normal business practice and is it legal? How can his actions be held against her?

If she's a CNA and will be handling controlled substances, having a family member who's had a conviction for something like that may be a serious strike against you.

Depending upon where you live a person can be fired for any reason. California is one of those places. You could be fired because they don't like your hairdo. While she is appealing this decision she should be looking for another job. Employers look at a lot of things and can hold them against you, driving records is one of them. Another one is your credit record. If you have poor credit that can keep you from being hired.

Doesn't sound fair, but is most likely legal. Most states allow for a person to be fired for any reason or no reason, as long as they're not fired because they're a member of a protected class (e.g. race, age, gender).

yes it is legal his actions might turn over on her and she might try to discrimanate secret -STUFF- against her company
