My son father owes back support payments, my child is now twenty five and i am still waiting for balance of payment to be made, however my last appearance to to support agency i learned that, because he has younger children whom he is currently paying support to, my claim has stopped until his obligation to his younger children have be met, i do not understand why i have to wait 10 to 15 years to get my support ordered payment to start up again. Is there any way i can stop this delay? and what happens if he continues to have children? Is there anyway i can press the issues to add on interest due to the delay on his behalf, just as he would have to pay interest, late fees, on other finacial obligations.

Current support to minor children does take presidence over payment of arrears. However you do have child support arrears still due to you and they have an obligation to enforce any IVD case. If the man is earning enough to have his current child support withheld PLUS any additional amount to pay arrears-he needs to be ordered to pay. Contact child support about enforcing an order on arrears.

Normally the 1st born, is the 1st child to be taken care of. Did you go thru the support collection department or thru the actual court room? I would speak with an attorney on this & if you haven't already .. File a petition in family court to get the support due for your child.. One should not have to wait that long. Check out your state laws on this as well.. I know in NY the 1st born, comes 1st. And as far as dealing with the support collection unit, they are horrible.. so in NY we are better off going directly to family court.

I'd sue him for back support and insist he begin payments now or take his car, house, etc. Get a good lawyer and go after him. Yes, you can usually get that interest on back support due. Otherwise, you might just have to wait until he dies to claim his back support money. And, since it was to support that 25 year old, they may give it to him at that point.

I had a similer situation the courts should be collecting arrears on anthing that is late. my county has a family law facilitator they provide free law services to women and men fighting for custody and child support you should see if your county has this service

I couldnt get it when it was due. I'll never get it now that they're all grown. In my opinion, it'll never happen.
I suggest you concentrate on being able to take care of yourself.
.....And forget the past, before it destroys you.
