My daughter is getting ready to turn 12 and i have been told that she can choose at that age whom she wants to stay with permently. Right know we have joint custody and he has her one week and I have her one week. Help me!

Most states now are letting the kids decide when they are able to reason. The judge usually takes the kids into his chambers with attys but usually not the parents and asks them some questions. If he feels the child has understood and answered the questions to his satisfaction the he will let them decide. I have heard of cases in which the judge let the kids decide when the kids were4 so try it and see. Then youll have to remodify the child support to fit the custody.Good luck

I was a ward of the court in Oregon at age 11. By age 12, my grandparents filed to get me and the judge asked me if I wanted to live with them and I said yes. He asked my grandparents and they said yes and that's where I went.
I think it is ultimately up to the judge, not so much what the law says.

well your right about that , your daughter can be called into family court and asked with whom she wants to live, and its about time, its hard for a child to be passed back and forth from one parent to another, but i admire both her parents for being able to do this without permament damage being done to the child. your daughter will soon be in the teenie bobber years where her friends with take a more important role in her life, and her schedule is going to get busier, perhaps its time you and your x discussed the options with her, and came to an agreement before going back into court, because if you don't you soon may find that she will begin telling you both what she is going to do not what she wants to do

I live in Missouri. The age is 14 for sure.

The courts in MO usually let you choose which parent when you are 14 or older.

Ask yourself this one simple question,Do you want what's best for your daughter?Then this one,Is she better off with her father? You need to put your personnel feelings aside and do what's right for your child.
