well i think that if she has all of that then she should have to pay. the kids are not resposible for that.

She is liable but if this were my Dad I would know how important it would probably be to him to leave no unpaid debts behind once I was gone.

I would pay just to honor him. Not everything is about money.

Little story here.. My father passed away a few years ago. He was a relatively wealthy man. Not that he had a lot of cash laying around his wealth was mainly in investments. Three weeks before he died he called me crying. He was battling a very painful form of cancer. His cash flow was strapped as he had just retired and he was not receiving his pension payments yet and his medicare wasn't covering all of his medications yet. His savings had been eaten up by having to pay for his medical expenses in the interim. My father had given me a fair amount of money decades before and even though I tried repaying him then he wouldn't accept it. I would hide money in his house and then tell him where it was after I returned home. He would throw a fit. So I stopped. Anyways, when he called me 3 weeks before he died he asked me if I could repay him the remaining amount of money that he had given to me years before. He was having a great deal of trouble dealing with the pain he was in. His pain meds cost about a $1,000 a week. I "owed" him $1,200.00. I never knew my Dad to cry. It broke my heart. I took out a loan to cover at least a months worth of medication for him and he had his meds the following day. When my Father passed away my Step-mom inherited his home, all the furnishings and all of his stocks and bonds. His estate was probably worth a half a million dollars or more. I'm not sure, I never got to see a will. I inherited nothing. When I asked for his favorite coffee cup and one of his flannel shirts she turned me down. I had *always* believed that my Father would leave something to his children. He didn't. That was his choice. So even though I thought I would inherit something it actually cost me money because I now had a $5,000 loan to pay back due to his meds. I don't regret it. I feel blessed that my Dad trusted me enough to come to me and ask when he needed a bit of help.

Money is nice but it isn't always the answer. Honoring a dearly departed loved one is the answer. It may not be fair what your Step-Mother is expecting of you but he was your Dad and look beyond the dollar signs. The day will come when you don't regret it.

Is she the step mother of the decedent or the spouse? I found the wording a bit confusing.

If she is his spouse, she is responsible. If she is his stepmother and the kids are the heirs, then they are responsible.

Ethically the step mom! if the children wanted to help that would be nice, but shouldn't be expected! good luck i believe the ruling will be in you favor:)
