I sue her for theft, damages and for 2 and half months rent she was owing me, she turn arround after 1 month she left and entered and encounter that I was harrassing her, I am representing my self in this case likewise she is, i never harrased her ,what should I do?

1. File a police report about the items you left and they money that is owed. Give the police the details of the theft...and when you purchased the things that were stolen...and anyswer any questions they have.

2. Take her to small claims court in your jurisdiction, and file PRO SE (BY YOURSELF).

3. Prove that you evicted her legally...hopefully you looked up the regulations and laws in your area.

4. You have a right to send her notice that she owes you the money, and you have a right to contact for the money.

5. Keep very good records of the items stolen, and the money received and when she paid in the past. Take pictures of the damage. Get estimates of what it costs to fix it.

6. Write down what she said, where she said and bring that to court.

7. You may realize that she will say she doesn't have money to pay....however the judge may enter a judgement for you...and sometimes you can even put it against her car.

Good luck - and I had that for over 20 years...with 5 properties...and I got very tired...of the attitude...they think they own the place.

You should not worry about the countersuit. Simply go to court with the evidence of your lossses, and hope for a satisfactory ruling. Most countersuits are filed only as retaliation for filing the suit initially, and most lack any sort of merit whatsoever. Don't worry about it, go to court and get a judgement. Good luck!

Use small claims court. no Lawyers allowed. You both state your side and judge makes dision.
