FDA is a self-regulatory agency with an oversight committee. So no one regulates them, however they must adhere to current regulations which they themselves have proposed to the Congress. The Surgeon General has no control over them, his duty is to advise on public health. The FDA is essentially staffed by professionals with qualifications in both medicine and pharmacology and any supervisory agency would have to exceed them in both authority and knowledge. With the currect licensing and approval guidelines, few drugs pass their safety checks and the bills for the testing are paid for by the pharmaceutical company. A normal drug might need many millions of dollars in research and testing before it is approved and this is why drugs cost so much. But it is better this way than to risk drugs like thalomide from slipping on the market. Mistakes do occur but tests involve hundreds and drug usage involves millions, so things do happen.
