The courts don't. However, when religion intrudes inappropriately to an issue that is completely a state matter, the religious community SHOULD be ignored.

A good example is the same-sex marriage debate. Marriage rights - like taxation, inheritance, and adoption - are given and regulated by the STATE. In our country, based on separation of church and state, religion should have absolutely no say in such an issue. In fact, truly 'christian' people should support equality and treating others well, just like that guy said - what was his name - oh yeah - Jesus!

Last time I checked, religious communities have their own sets of Religious Law or Law Canon which is administered by religious courts, including each and every Christian denomination. If those enforcing and adjudicating the Canon of your church are not doing so in the interests of your parishoners and rather in favor of some outside community of gays as your question implies, then you might file proper greivances with higher authorities in your church.
Otherwise, the Courts of Law and Record of the civil governments of the various 50 American States answer to the voters and their representatives and if you cannot muster a sufficient vote or religious jury pool to sway their actions properly, it sounds like democracy, the tyrrany of the majority, is working just fine in our fair land.

Because gays are not trying to limit the rights of the religious community the way that many members of the religious community are trying to limit the rights of gays. If gays were trying to prevent you from adopting a child or getting a job soley because of biased beliefs about your religion, the courts would protect you too.

Because there is supposed to be a separation of church and state...the government is supposed to allow freedom of religion, and the churches are supposed to stay out of the governments issues which include courts, laws, etc
