holding one self out to the husband or wife of the person with whom one is cohabitating is not necesary to constitute.

im studying law.but cant get the true meaning of this.

I think you missed out a word... holding oneself out to BE the.......

It would be my understanding that they are saying "You do not have to be married to someone to be classed as co-habiting"

In th family code it then gors on to say that you need not be of the opposite sex either - which to my mind is basically further suggesting that the bit you are unsure of is simply saying "you don't need to be married to be classed as cohabiting"

Horrible wording I grant you.
