It all depends on whether he is selling the picturs and follows the guidance on ebay and hat he states that it is just a pic.
This is in breech of copyright and the copyright owners could sue him for royalties if they want. eg up to 90% of his sales and about £5000 in solicitors fees. this is a civil matter and the police will not get involved.
if he is advertiseing the phone and has led customers to believe that it is the phone that they are getting eg states 'charger included' etc etc then yes it is obtaining money by deception. He will most probably get a caution (for one or 2 sales), but could go to court and may recieve a sentence of 5 years or more.
But it all depends on what he is selling AND how it is advertised. It could all be legit.
Anyone remember the people selling an xbox box for £100 when the xbox was first released?

Well if he doesnt have the phones, then chances are, he'll get caught. He'll probably only get a caution, but if a desctuntled ebayer gets your adresss, which they will (once the claim is initiated), I dont fancy the chances of your windows staying unbroken.

It certainly is, and he is a low life who is thieving off honest people who work hard and he is going to give e-bay a bad name. This type of theft is personal theft. You should report him to e-bay anonymously.

i know hes ur friend and all that, but report the guy. imagine if your mum or a relative bought that fone, how would u feel.

well the first thing he need to do. is to give you a phone, so you can use the spell check...that way we could read your question properly....and if he sells them on eBay then he deserves a prison sentence
