My husband's child support agreement went off his income 7 years ago when he lived in the barracks, so had no bills. Now he's re-married, with two additional children, a mortgage, 2 car payments, etc. We both work and now I'm about to start my second job to make ends meet. $600 seems a little high for one child. His ex is remarried herself and gets to stay at home! Please help if there's a way. Thanks.

absolutely!

depending on where the child support is filed, either at family court or with child services.
both require a Modification of Child support. It's an OSC form and it has a modification box on it for child support. Use the original case number for this form. it should include the income and expense form. Read the form carefully. the form will let you know what other forms you will need to fill out to acomplish what you want.

you can also talk to a paralegel as they will be more knowledgable for your area and way cheaper than an attorney.

Yes contact the court where the orders were originally done through. Ask them for a review of order. Both parents will have to complete a form & submit it to the system. It will be reveiwed & decided. Remember though if both parents are remarried the income from them will be included in the figures. It also makes a difference if there are additional kids with the current spouse. A review HAS to be requested to the courts by one or the other parent or it will stay in place until the time is up.

To get child support lowered, it will have to go back through the court system, and let the judge decide. It happens on occasion, but I wouldn't get my hopes up. The judge does not take into consideration any children from his present family....he knew he had a child before he got remarried, and had more children. I'm not being unsympathetic, but I have sat in court a lot over the years, and heard the judge say just those words to people. Ask a lawyer what he thinks before you take it back to court, costing you time and money. Good Luck!!

Yes! I can tell you that in Texas child support is based on both his income and his new spouse, it doesn't matter how much your bills are or how many children he may have with the new spouse, Texas will take a total of 20-23% of the combined income. The court, in cases my family have experienced, didn't consider outstanding mortgage, autos and our other children.

Unless he has a lower paying job I would mess with there is a possiblity of making it worse my ex did that and it tripled unless you want to try to go through lawyers it may help that way but please dont try it yourselves

Frankly wifey number 2, HIS child support is really NONE of your business. HE MADE her, HE supports her til she's finished school.

However generally people go back to court to get support reduced.

You're just po'd because she gets to stay home and you don't.
