Is it illegal to record my mother in a conversation with me on the phone and give it to my dean of studnts so that he'll listen to me? Without her consent of course. Because it's family, doesn't it change the law? HELP.

Wire tap laws vary from state and whether they can be used in court varies from state to state. Mostly though, if its your phone and you know you are taping the conversation it is legal. It may or may not be used in court depending on the state law. I firmly believe in taping other people. Its the only way you can get some people to tell the truth or hold them accountable for something they said.

Hi sweetheart. Just one question before I tackle yours! Do you and have you seen him beating her, evidence such as bruises and cuts? Take pictues of them if she does. Now! does he ever leave the house? I hope so, cos that's the only way you are going to able to find the bugs. They are very small, and can be hidden very easily! If you can get him out of the house, start in one room from top to bottom. Telephone, light fixtures, books, window sills the whole nine yards. But how can he bug her at her place of work? unless HE works there too? He may bugging her to find out if she is talking to anyone about his abuse. I hope to God he doesn't OWN the place where she works, if he does, he can bug her and say he was just monitoring her to see if she is doing her job right! Best thing to do is get her out of that house, and get her to a women's shelter, Even if you have to pretend to go with her to the store - and don't let her go back. Try to get it through her head, that one day, he will do something a lot worse then buggng her.and ask her if she wants to land up dead! These kind of women are in denial. He doesn't have to beat her to be abusive, what he is doing is mental cruelty. Just tell her, she may think it is HER problem, but it is also YOURS! She's your mother and you just can't stand by and watch her being destroyed! Tell her to leave him for YOUR sakes!

It's called "one party consent" ... you can consent to record yourself talking to one other person legally, if there is more than one other person then you have to get consent.

The implications for court are dependant on your State. As far as the Dean, he can hear "your" conversation with another party including your mother.

I believe that most phone books explain the law concerning this. The best thing to do is get on the FCC web site and call your local phone company.

Why do you want to record your mother on the phone? Would you like it if she did this to you? If she is doing something bad to you then seek help-if not don't push your luck!

no it doesn't change the law, you might talk to dean of students and ask what you can do to get him to listen to you besides recording your mother secretly?

its illegal to tape and record anyone without there consent on the telephone..even if it is your mom, ask her first

its illegal if they are not aware or without their consent. Careful you might get into trouble.

She would need to know she was being recorded.
