If there is enough evidence, the jury can already made a decision declaring the accused as guilt.

Barring illegals from work and school is not violative of the constitution because the state has the right to regulate immigration as a valid exercise of police power.

The state has the right to abolish abortion if it deems that it is against morals, public policy and the laws.

Grand jury would come back with an indictment. For lesser crimes a prosecutor could file an information. Your other questions depend on state statute. What state are you in?
