Kmart refuse to allow us to view the tapes

File a case in court so that the court will order Kmart to produce the tapes for viewing.

What you can do is report the vehicle stolen and the police will investigate the matter by getting ahold of the tapes. Once you report the vehicle stolen, if any police officer runs the plate, no matter what city or state, it'll come up as stolen. So you have to report it.

And Kmart is probably not involved. They just can't release security tapes to the public. For all they know, you could be faking the story of your vehicle being stolen to get the tape. So let the Police handle that matter. They have the power to get the tapes.

If your brother had a police report done at the time of the theft then K-Mart should have turned over the tape ( or at least a copy) to the police. If the thief is caught, then the D.A. can have it court ordered to retain a copy of the tape. Also getting a lawyer at this point (unless the thief has been caught and going to trial) would not necessarily do you any good. Even though it was caught on tape , the tape will remain K-MArt property until a court trial. Sorry to hear of your misfortune. You can however call the investigator (if there is one) or the officer on your report ( if one was made) to see what if any leads they may have, and at that point ask them if they have gotten a copy of the tape to see if they can ID the thief. They would not generally be responsible for the theft.

Contact your local police department and tell them Kmart has surveillance camera footage that may show the theft occurring and let them handle it. Also, call the insurance company to report the loss, and let them know about the tapes as well.

Disregard the previous answer about a lawsuit. If you file a lawsuit against Kmart you are wasting your time and money, as it will most likely be thrown out of court. It will get you nowhere.

Kmart does not have to let you view the tapes, but they do have to allow them as part of the police investigation. The police can easily get a court order to get them if Kmart refuses.

Those tapes are private property, and they do not have to allow you access to them. The only way they have to give them up is with a court order. They do that for security reasons.

They are not responsible. The purpose of the cameras is for the protection of their property only. Parking anywhere is done at your own risk because it is accessable to the public. No retail establishment is liable for anything that happens on their property unless they are directly at fault. If Kmart ordered one of their staff to steal your brother's car, then they would be responsible.

The law can view the tapes, if they don't willing allow an officer to view them, then take them to court and have a judge give a court order to view them

Of course K-Mart aren't responsible however, like the first guy said get an attorney involved and those tapes will become your evidence.

if u submit a police report, the officer will go to kmart to check surveillance. if something pops up, the cop will receive a copy, and it will be filed as evidence.
