I have been asked to create a site so people can 'Name and Shame' drivers who use mobile phones while driving! (as long as it is safe to do so, obviously!)

But...

What is the law on this ?

Can someone take a photo of someone who is using their mobile while driving and publish it?

There are sites out there and publications that 'Name and Shame' for other reasons, can this be done for most things, namely drivers using mobile phone while driving their cars?

ADDITIONS TO MY ORIGINAL QUESTION.........

I am from the UK.

The reason My friends and I wish to do this is the fact that a friend and I have nearly been a statistic!

While walking on the pavement a car nearly mounted the pavement and could easily have continued to plough in to my friend and I !!!

Also I have recently seen a tv programme where a traffic cop had to do the unplesent job of informing the loved ones of their loss due to a lorry driver using his in cab phone while on the bl**ding motorway!!!

All this have prompted me and a few friends to get together to try and do something to save at least one life if not all that can be saved, by having this sort of site.

Depends on where you live, check your local state laws. In the state I live in you can legally take photos of others with out their consent. Not sure about posting for public view, Good Luck!

As far as I know it is legal, As a Investigator I take pictures and even videos of people driving all the time. Unless the law has changed, you will find that the law and the courts have said that there is " NO expectation of privacy " when someone is operating a motor vehicle. So go ahead and build that web page.

You'll have to check with the privacy laws in your county and state, but to be quite honest, I don't know why you'd want to waste your time. Also, be prepared for inevitable lawsuits against you.

Personally I really wouldn't give a damn if someone posted a pic of me driving and talking on the phone. I'm certainly not ashamed or sorry for it and if Name and Shame would like to hire a personal assistant for me to return/filter my calls, I'd be happy to consider putting down my phone (and latte) while I drive. Otherwise, I'll continue to multi-task.

it's a privacy issue

and exactly how are people getting these photos? Are they using their cell phone camera while driving? Is this redundant?

Yes jason it is legal until soemone explains legal up the side of your head:):).
Once i stopped to raise my hood to see why my truck was running hot and put some water in it.
A guy caught me on his camera runing after the top came off sprewing hot water everywhere(it';s normal to move when hot water is pouring all over you.
The local newspaper printed it refering to old faithful. Had I gotten ahold of him he would to day be hard of hearing, and short of teeth.

you can get in alot of trouble if one of the person see,s their self on vidio,they can sue you for invasine of privicity,but if you put a black bar over their eyes in vidio,then you really can,t get in trouble because you hide their idenity!but I really don,t think thats a good Idea,I think you should fine a new project to work on!Hollywood
