Ex and I brought a home whereto on the contract it is listed as tenants in common. I want to sell the home but he wants to keep it. Can I get a judge to force a sell?

You can ask a judge to have him buy you out. If it is a land contract you will have to make sure the person you are buying the home from is in agreement with this because he can easily take back the property. You can also ask a judge to have your ex sign a quick claim deed which will hand the property over to you and his name will be completely off the property in order for you to sell the property. A judge may tell you that you have to give your ex half if you do sell the property depending on what your divorce decree says.

You can ask that any real property be sold and divided between you two. If the ex is resistant and wants to keep the property a judge is more than likely going to order a payoff to you for the half. Is the ex financially fit to pay you half of the real estate value out of pocket?

It has to be an equal agreement between both tentants. He would need to sign off the title for you to sell the house. I went through this with my ex-fiance so I know the details pretty well. Depends on what state you live in. Are you divorced? There should have been a settlement of joint property. In some states he has the option of buying you out and keeping the house.

You can only sell your half (or whatever percentage you own). A judge will not be able to make him sell.

more than likely the ex would have option of buying you out, that way you both win.
