i need to get this started but i don't know where to start. does this have to go before a judge or can we just file paperwork and pay the fees?

This will be very easy to do. In California, all you have to do is fill out the paperwork which you can obtain at the court house (family law section) for a minimal fee. Or, you can even find the paperwork online for the county you live in. I've done it, and the process is very simple. If you are low income, you can get the filling/court fees reduced. You do not need to go before a judge. Once you file, the divorce will be finalized within 6 months. Good luck!

ok I just did this myself in stanislaus co and it was a huge pain in the ***!! you go to your county court house and pay a small fee for all the paperwork and then you must know how to fill it out including all the legal jargon. if your papers are not worded properly they will be sent back to time and time again. you have your fees to pay to the court for filing and then the other side must pay their fees also when they respond. the court will not give you any info on how to do things etc because they are not legal advice. since you have no children from the marriage you prob wont' be able to get legal assist from the court. if I had to do this all over again I would pay a lawyer. to much stress and took way too long for my marriage to be divorced. also if papers get lost in the mail you are so screwed cuz you have to figure out what papers were in the mail and re-do those. and para legals are a joke. get a lawyer for the county you live in or the divorce will be held in. must be a resident of county for at least 6mo at time of filing. each county is different for their requirements too. so if you live in one city and the county changes you wont' be able to get help from different courts. good luck and hope this helps

Hi Ryan, You can do your own divorce and pay the fees,but i think the judge has to sign the divorce papers. When you go and get all the paper work for a divorce ask the person you pay the fees to. They should know for sure and i live in California to.

Had a friend who had an uncontested divorce
in Long Beach California: All he did was hire a
lawyer and the lawyer represented him and he
took care of everything to include notifiying the
other half, when it came time to go to court
the lawyer went in be-half of my friend as he
was in another state at the time and the di-
vorce was approved in court because it was
un-contested. The lawyer then had all final
paperwork sent to both parties as the divorce
was final. Only clitch was no-one could re-
marry until six months after the divorce was
final as that is the law in California, unless they
have changed that by now.

The judge is the one who makes it a legal divorce and he must accept your terms. You probably would then have to submit the Stipulation Agreement for final approval. I would imagine you have the legal right to do this paperwork yourself. Start with the court clerk to see if you can get a list of things you need to do.

No kids or property? Lucky you. California is tough on males in a divorce.

However, I do think you'll need to appear before a judge, you might ask someone, maybe the County Clerk, at the courthouse.

You should be able to file the paperwork on your own. There is a kit to help you with the legal jargon needed. Check with the local library or the courthouse to see what you should do.

I would imagine it's the same as AZ.....we just hired one attorney, paid the fees and filed the paperwork. It was easy.
