Hi everyone
I just married in few days ago, my photographer told me that he lost some parts (photos with my guests in wedding dinner) of my wedding photos. I'm very unhappy right now. I already paid the service but the photographer only gave me two parts (morning and afternoon) missing dinner. He also said I signed the paper that regarding his libility. He only pay less than $100 to me. I said it means nothing because I spent $10,000 to invite my guest to attend my wedding dinner and right now he lost that part. why do i spend this money $10,000 and get nothing on it.
Please give me some advice?

It depends on how much he charged you for the photography services. If he charged $300 and gave you back $100 , than that is probably fair, and you probably won't get anymore money, even if you sue. If he charged you $1000, then you are probably due a little more money, in the neighborhood of $300 to $350.
Unfortunately for you, you probalby cannot get a full refund, even if you sue. The courts will say that he provided a service from which you recieved some benefit. Though you are not satisfied, if the court were to order a full refund, it would invariably carry the stipulation that you must return ALL the photos that the photographer took, since they are his property if you don't pay for them. You most likely want to keep what photos you did get, so that rules out the full refund. Also, no matter how angry you are, you cannot recover damages for your anger and disappointment. You can only recover actual damages, which would be around 1/3 of the contracted price, since the photographer delivered on two of the three parts of the wedding you wanted photographed. You cannot recover any of the monies you spent on invitations and dinners, ect. Those things were seperate from the contract for photography services, and occured outside the control of the photographer, so you cannot recover ANYTHING for that, even though you feel upset that you spent that much money on the dinner and have nopictures of it. The photographer simply cannot be held liable for those expenses.
Sorry, but you don't have a lot of options. Small claims court is the place to sue for this, but again, depending on how much money you could get, you have to ask yourself if it is worth it.

If you sign a contract with lots of fine print, then you probably signed your rights to a larger refund, away. Write a letter to the photographer stating your protest. See what they offer you. If it's not what you want, go to court, or small claims court if the amount is within the max. legal amount for small claims court in your state.

small claims court AND the better business bureau. i understand what you are going through. our wedding photos were done by my stepmothers brother and he lost the photos all together!! the only thing we have are the proofs, not to mention the fact that he missed taking my inlaws pictures and a few more key ones....

What does "lost" mean? If they are digital they are not lost. Have him send his digital cards in to be recovered. Nothing is ever erased on a digital card or hard drive. Companies like OnTrack and others can recover them if he overwrote them.

Call your lawyer, I have a link that you can check into getting service for incidents JUST LIKE THIS.

Lawyer contacts photographer, and will let him/her know your serious as a heart attack about your problem.

Come to a compromise and be done with it.

depending on the situation you should be able to get more $ back. in some cases you can take him to small claim courts..if you are really unhappy. i would too!! good luck!

I think you should document all your papers, send him letters requesting for a refund. If he doens't comply, file in small claims court.

Take him to small claims sweetie. Usually works. That's about the only way that you will be able to get anything out of him.
